Terms of Service

These Terms of Service ("Terms") govern your access to and use of Optimus, a forex backtesting platform (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

Optimus lets you replay historical foreign-exchange price data, place simulated trades with stop loss and take profit levels, and analyze the results with performance metrics, charts, and a trade journal. Everything on the platform is simulation: no real orders are placed, no real money is at risk, and Optimus is not connected to any brokerage or live market.

• You must be at least 18 years old to use the Service.
• You sign in with a Google account and are responsible for keeping that account secure.
• You are responsible for all activity that occurs under your account.
• You may not share, sell, or transfer your account to anyone else.

Optimus is an educational and analytical tool. Nothing on the Service — including metrics, charts, sample sessions, templates, or any other content — constitutes financial, investment, legal, or tax advice, or a recommendation to buy or sell any financial instrument.

We are not a broker-dealer, investment adviser, or financial institution, and we are not licensed or regulated as one. Trading foreign exchange on margin carries a high level of risk and may not be suitable for all investors. You could lose more than your initial investment. Before trading real capital, consult a licensed financial professional.

Results produced on Optimus are hypothetical. Backtested and simulated performance has inherent limitations:

• Results are prepared with the benefit of historical data and do not represent real trading.
• Simulated fills do not fully account for spread variation, slippage, commissions, swap, liquidity, or requotes that affect live execution.
• Historical data may contain gaps, errors, or differences from the feed of any particular broker.
• Simulated trading does not involve financial risk, and no simulation can account for the psychological pressure of risking real money.

Past performance, whether real or simulated, is not indicative of future results. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown on the platform.

Historical price data available on the Service is provided for backtesting purposes only, on an "as is" and "as available" basis. We do not warrant that it is accurate, complete, or free of errors, and it must not be relied upon for live trading decisions. You may not extract, scrape, resell, or redistribute the data outside the Service.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Probe, scan, or test the vulnerability of the Service, or bypass its authentication and rate limits.
• Reverse engineer, decompile, or copy the Service or its data feeds.
• Use automated tools to scrape the Service or place excessive load on our infrastructure.
• Misrepresent simulated results produced on Optimus as real trading performance when soliciting funds from others.

The Starter plan is free. The Pro plan is a paid subscription (currently $5/month or $60/year during early access); pricing is always shown clearly before you are charged, and you can cancel at any time — access continues until the end of the period you have paid for. Data you created under any plan remains exportable. Billing is handled by PCI-compliant payment processors (Stripe and PayPal) — we never store your card details on our servers.

You retain ownership of the backtesting data you create — your sessions, trades, notes, and tags. You grant us a limited license to host and process that data solely to provide the Service. The Service itself, including its software, design, branding, and content, is owned by Optimus and protected by intellectual-property laws; these Terms grant you a personal, non-exclusive, non-transferable right to use it.

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access if you materially breach these Terms, abuse the platform, or create risk for other users, and we may discontinue the Service with reasonable prior notice. Upon termination, your right to use the Service ends, and we will delete your data in accordance with our Privacy Policy.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will never be lost — keep exports of anything critical.

To the maximum extent permitted by law, Optimus and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any trading losses, lost profits, or lost data arising from your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty US dollars.

We are actively developing Optimus and may add, change, or remove features at any time. We may also revise these Terms; if changes are material, we will update the date above and notify you in the app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the jurisdiction in which Optimus is established, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, unless applicable consumer law provides otherwise.
